Local delivery truck returning to a terminal in the evening

16 Hour Short Haul Exception: 3 Conditions to Qualify (2026)

Local drivers sometimes face one day a week that just runs long. A late delivery, a slow dock or a breakdown pushes you past your 14 hour window before you can get back to the yard. The 16 hour short haul exception in 49 CFR 395.1(o) gives property carrying drivers a little relief on that day. It is narrow, and it has three conditions that all have to be true.

What the Exception Does

Normally you cannot drive after the 14th hour after coming on duty following 10 hours off. Under the 16 hour exception, you can extend that window to 16 hours one time. The 11 hour driving limit stays the same. You do not get more driving time, just a longer day to fit it into.

LimitNormal day16 hour exception day
Driving limit11 hours11 hours
Driving window14 hours16 hours
Weekly limit60 or 70 hours60 or 70 hours
How oftenEvery dayOnce per 7 consecutive days, or after a 34 hour restart

The 3 Conditions

1. Released at your work reporting location for the last 5 duty tours

For the previous 5 duty tours, you must have returned to your normal work reporting location and been released from duty there. This is what makes it a local driver rule. A driver who spent a night out on the road in the last 5 shifts does not qualify.

2. Back and released within 16 hours

On the day you use it, you must return to the same work reporting location and be released from duty within 16 hours of coming on duty after 10 consecutive hours off.

3. Not used in the last 6 days

You can only use it once every 7 consecutive days. The exception is if you have taken a 34 hour restart since the last time you used it, which makes it available again.

Worked Example

A driver for a building supply company starts at 5:00 a.m. every weekday and is back at the yard each evening. On Thursday, a job site delay means the last drop finishes at 6:30 p.m., an hour and a half from the yard.

CheckResult
Released at the yard for the last 5 duty tours?Yes, Monday to Wednesday plus last Thursday and Friday
Used the 16 hour exception in the last 6 days?No
Back and released by 9:00 p.m.?Yes, released at 8:15 p.m.
Driving time under 11 hours?Yes, 8.5 hours

All conditions are met, so the late return is legal. If the same thing happens on Friday, the exception is not available again, and the driver has to stop driving at the 14th hour.

How It Differs From the 150 Air Mile Exception

These two get mixed up often. The 150 air mile short haul exception in 395.1(e)(1) lets drivers skip a full record of duty status if they stay within 150 air miles and are released within 14 hours. The 16 hour rule is different. You still keep a regular log, usually on an ELD, and you simply get a longer window once a week. Our short haul exemption guide covers the 150 air mile rule in detail.

Full log or ELD needed?YesNo, time records instead
Window16 hours, once a week14 hours every day
Distance limitNone stated, but you must return to base150 air miles

Drivers using the non CDL short haul exception in 395.1(e)(2) cannot use the 16 hour rule as well. That exception already gives them two longer days each week.

Logging It on Your ELD

Some ELD apps have a 16 hour exception toggle that extends the window on screen. Others do not, and the app will flag a violation that is not really there. Either way, add an annotation explaining the day, such as "16 hour exception, released at yard 8:15 p.m." Keep the records that show you were released at the yard for the 5 prior duty tours. That history is the first thing an auditor will check.

One more practical point: dispatchers should know when a driver plans to use the exception. If dispatch sends a late add on stop after the 14th hour has already been stretched once that week, the driver has no fallback and has to stop wherever the clock runs out. Planning the long day in advance, and saving it for real surprises, keeps the exception useful.
